สรุปความคิดประจำสัปดาห์

สติแตกอ่านหนังสือไม่รู้เรื่อง ค้นข้อมูลทำรายงานก็ไม่ได้ มันจะอะไรกันนักหนาฟระ..หงุดหงิดตัวเองอย่างไม่มีสาเหตุ..เลยเปิดบล๊อคของแมวซ่าวิฬารี หาความรู้สนุก ๆ อ่าน แล้วก็ไปเจอเรื่อง ๆ หนึ่งที่น่าสนใจจนต้องเอากลับมาคิด

เมืองไทยกับคำว่า ลิขสิทธิ์...มันเป็นอะไรที่ไปด้วยกันยาก เพราะพื้นฐานความรู้,วัฒนธรรม ค่านิยม จนกระทั่งวิธีการคิด ก็ต่างจากประเทศที่เป็นคนกำหนดกฏเกณฑ์ขึ้นมา..แต่เราก็ต้องเล่นไปตามเกมของพวกเขา

อะไรคือ Intellectual property rights ขอยกข้อความมาจากรายงานที่ทำส่งไปเมื่อเทอมที่แล้วนะเพราะว่า ขี้เกียจพิมพ์ ขี้เกียจแปล

Intellectual property refers to creations of the mind; inventions, literary and artistic works and symbol, name, and images used in commerce (WIPO, 2005)...

According to the Universal Declaration of Human Rights, Article 27 stated that “everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author” (Universal Declaration of Human Rights, 2005). Therefore, intellectual property rights is same as other property rights that allow the creator, or owner of a patent, trademark or copyright to benefit from their work or investment.

พอเริ่มคิด..กลไกความคิดก็ทำงานต่อจนต้องหยุดเรื่องรายงานที่จะส่งต้นเดือนหน้าไปก่อน เรื่อง IPR น่าสนใจ แต่ที่น่าสนใจอย่างยิ่งไม่ใช่เรื่องการละเมิดลิขสิทธิ์ในงานเขียนนะ คุณลองคิดถึงเรื่องสุขภาพดูสิ..

ประเทศไทยหรือประเทศที่ถูกเรียกขานว่า Developing country ต่างก็ไม่ได้เป็นคนคิดค้นยาปฏิชีวนะ แล้วเราก็ไม่มีเงินมากพอที่จะซื้อหรือจ่ายค่าลิขสิทธิ์ราคาแพงได้ หรือถ้าเรามีปัญญาทำได้ คนป่วยคนเจ็บคนไข้บ้านเราล่ะมีปัญญาจ่ายหรือ...

เรื่องนี้มีการถกเถียงในวงกว้าง แม้กระทั่งเวทีการเมืองโลกเองก็ตาม จะอธิบายเรื่องนี้ก็ต้องขอเปลี่ยนไปใช้ภาษาต่างด้าวนะ..คนที่หลงเข้ามาอ่านคงจะสงสัย..ทำไมวะ...

Because an explanation is limited by culture thus, some words or phrases cannot be understood by some culture due to the differential conceptions. For example, Individualist cultures do mind about ‘privacy’ but the collectivist cultures don’t event understand this word as they do not have a vocabulary to replace the idea. What is ‘privacy’ in Thai? Surely, it’s not only สิทธิส่วนบุคคล

Focusing on our point, according to WIPO there are several reasons why intellectual property rights are important. For example, the progress and well-being of humanity rests on its capacity for new creations in the areas of technology and culture; the legal protection of these new creations encourages the expenditure of additional resources which leads to future innovation; the promotion and protection of intellectual property spurs economic growth; and intellectual property system will balance the interests of the innovator and the public interests (WIPO, 2005).

Moreover, some people believe that patents are needed to promote pharmaceutical innovations especially on research and development. Therefore, the developed countries perspective can explain under the Orthodox perspective as they claimed that the act of innovation incurs development costs and runs the risk which outcomes will not succeed (Plahe, 2005). Therefore, some believe that the patent system offers the innovator the opportunities to gain some rewards from his or her innovation (Macdonald, 2002). It is true that, the innovators need huge money for researching and developing their products therefore, the patent system was set for motivating innovation because without compensation for costs and risks, incentives for such work are non-existent. Therefore, in the developed countries points of view, protection of intellectual property rights is essential to motivate people to put energy into generating new ideas and to motivate those who have new ideas to make them public.

On the other hand, most of the developing countries have been affected by the growing monopolization of intellectual property in the hand of a few powerful titleholders because the TRIPS agreement restricts access to medicine and protect the patent which leads to the higher costs. Williams adds that the TRIPS provisions do not provide much flexibility and allow considerable scope for interpretation and leave poor countries vulnerable to dispute action and legal harassment (Williams, 2001).

Additionally, the opponent of intellectual property rights can be explained as Heterodox perspective because this school believe that much knowledge is generated in the public arena and even that which is not should not be monopolized (Plahe, 2005). They also claim that even if intellectual property rights is an incentive to generate new knowledge but only a few industries need for intellectual property rights and the innovators can enjoy many natural protective measures such as imitation lag due to the cost of absorbing new knowledge and head start along learning curve (Plahe, 2005). It is clearly that TRIPS has negative effect on poor countries especially in pharmaceutical area. Kamal and Bailey claim that patent rules will delay the availability of cheaper generic alternatives to recently developed products. Once, developing countries are allowed to manufacture low-cost medicine as can be seen that a copy of the antiretroviral, HIV/AIDS treatment was retailed at 0.6 US$ in India whereas, it was 4.9 US$ in the US (Combe at al., 2003).

In my opinion, we should set two prices for essential drugs; patent-protected for the developed countries and lower-costs for poor countries suffering from public health crisis like sub-Sahara countries. This should not affect on Research and Development as Lanjourw (2002) explains that in 1999 the countries with GDP per capita lower than 2500 US$ together contributed less than one half of one percent to global spending on ARV medicines. Thus, Combe adds that the price sold in developing countries should not affect the developed countries market and neither they should they reduce the incentives to innovation by pharmaceutical corporations (Combe at al., 2003). In fact, in developed countries also have poor people, this may affect them but as the developed countries have better social welfare especially health care, thus the poor people in developed countries may not be affected.

Moreover, I believe, we should place public health interests before commercial interests. Patent protection is important but not for the life-saving drugs unless, we have world fund for R&D or public health aids for developing countries then we can apply patent protection to pharmaceutical products.

However, in this current situation, the TRIPS agreement is applied to all WTO memberships therefore the developing countries have to seek the solution to avoid great impact especially from the trade sanction.

Lives or Laws...Such a difficult decision!!!

จบล่ะ..เรื่องสนุก ๆ ของเราแต่เป็นเรื่องเครียด ๆ ของคนอื่น บางคนเขาบอกว่า ในสมอง(สวยๆ) ของนกตัวน้อย ๆ นี้มีแต่เรื่องน่าเบื่อ เต็มไปด้วยสาระที่แสนเครียด แต่จะให้นกตัวนี้ไปคิดเรื่อง วิกตอง,กุดชี่, ปราด้า..ก็ทำใจไม่ได้เพราะไม่ชอบและไม่มีความรู้ จะพูดเรื่องหนุ่ม ๆ หาคู่ มันก็รกสมองเสียยิ่งเพราะยังหาคู่ไม่ได้ จะให้ไประริกระรี้นินทาแต่ภาษาไทย...แล้วนกตัวนี้จะบินจากบ้านมาทำซากไรฟระ..

เ่เพื่อนบางคนก็ปลอบว่า คนเราไม่เหมือนกัน จะให้ไปไร้สาระตามกันก็ประหลาดแล้ว...ในเมื่อรับเราที่เป็นเราไม่ได้ก็ปล่อยไป เรามีค่ามากกว่าที่จะไปเสียใจกับคนที่ไม่ควรเห็นค่า...

ปราญช์ควรคบปราญช์ บัวสมัครใจจะอยู่ใต้น้ำก็ปล่อยไป...จะฉุดขึ้นมาทำไมให้ตัวเราเปรอะเปื้อนโคลนตม..

คิดในแง่ดี คือ การคิดในสิ่งที่ทำให้เราสบายใจ...คิดในแง่ร้าย คือ การคิดในสิ่งที่ทำร้ายจิตใจตัวเอง...

วันนี้นกน้อยเลือกได้แล้ว...เพราะไม่มีใครทำร้ายเราได้เท่ากับเราทำร้ายตัวเอง...

คำกล่าวที่พี่นกเล่าสอนเป็นประสบการณ์..อยู่ต่างบ้านต่างถิ่น ห่างคนไทยได้ก็เป็นดีแก่ตัว...นกน้อยก็เพิ่งจะรู้ซึ้งก็เมื่อจะเรียนจบนี่เอง...นกยาจกอย่างเราจะเข้าฝูงหงส์...เหอ ๆ ประหลาดใจตัวเองนัก..ช็อปฯกันสนั่นวันละ หลายร้อยเหรียญ กี่พันกี่หมื่นบาทละนั่น..นกยาจกหัวใจจะวาย พอเตือนก็บ่น หาว่าเชย เฉิ่ม..เอาเถอะนกน้อยขอบินเข้าฝูงตัวเองดีกว่า ปล่อยหงส์แท้หงส์เทียมให้เริงรมย์ในสระสรรค์ต่อไป...

เพื่อนร่วมฝูงของนกน้อย ส่วนใหญ่เป็นนักเรียนทุนจากชาติต่าง ๆ ทั้งประเทศยากจนและรวย มีตั้งแต่หัวทองผิวขาวตาฟ้า ไปจนกระทั่ง ตัวดำคล้ำผมหยิกขอด...เพื่อนนกน้อยบินมาจากหลายพื้นที่..เกือบทุกคนเป็นข้าราชการของประเทศนั้น ๆ ปัญหาและความรู้ประสบการณ์ของพวกเขาได้ถ่ายทอดมาสู่นกน้อย..จนทำให้ความฟุ้งเฟ้อที่เคยมีของนกน้อยลดถอยลง...

เพื่อนนกน้อยคนหนึ่งเป็นนักเรียนทุนสองประเทศ...เพราะประเทศในแถบแอฟริกาไม่สามารถส่งนักเรียนมาเรียนไกลข้ามทวีปได้ จึงต้องรวบรวมเงินกันสองประเทศส่งมาหนึ่งคน กลับไปก็ทำงานพัฒนา เป็นปากเป็นเสียงให้กับทั้งสองประเทศ เขาถือสัญชาติไนจีเรีย ตัวดำขนาดที่ถ้าปิดไฟเรียนก็มองไม่เห็นเขาล่ะ...เพื่อนอีกคนหนึ่งมาจากอิสราเอล ประเทศเขาก็รบรากันทุกวัน เลือดน้ำตาไอปืนกลิ่นระเบิดเป็นเรื่องที่สัมผัสได้จริง ไปคุยกับคน ๆ นี้สิจะได้อะไรมากมาย จนทำให้อดคิดไม่ได้ว่าทำไมนกน้อยจึงหลงในมายาที่จับต้องไม่ได้

แต่เอาเถอะ..อย่างน้อยนกน้อยก็ต้องขอบคุณฝูงหงส์ที่เคยเป็นเพื่อนคลายเหงาให้..แม้ไม่มีเขาเราจะเหงาแต่ประสบการณ์ครั้งนี้สอนให้นกน้อยเติบโต  จากนกตัวน้อยจะกลายเป็นเหยี่ยวหรือกา..ก็รอดูไป...หวังไว้แต่วันหนึ่งวันหน้าหงส์ที่หยิ่งยิ่งใหญ่จะไม่มาพึ่งพาเรา!!
